    Unhappy Two Jobs

    My question involves unemployment benefits for the state of: CA.

    I was let go of my first job on MAY earning $57k a year and to meet my expenses I had a second job that paid me $22k.

    When I was let go of my first job, I fild for unemployment and was given the max of $450 whcih was less that half of what I got at my last position.

    I was not aware that I had to report my second job earnings so they are asking for a explaination why I did not report my other earning; I did not think I need to do so.

    The irony of the story is, it is september 10th and as of the 16th I will no longer have my second job.

    How do I explain my case so I do not loose my unemployment benifit? and still get my max pay of $450. I have gone through my savings, jobs are hard to get and I have a mortgage of $1,950. I do not want to loose my house.

    I do not qalify to get a loan on my house becuase I do not have a job. what do I do?

    Why in the world would you think you didn't have to report earnings from your other job? The instructions are very clear.

    4. Weekly Benefit Amount: This is the amount of your weekly
    benefi t. It is the amount you will receive each week if you meet all
    eligibility requirements. If you work part-time and earn more than
    $25, but less than $100 in a week, your weekly benefi t amount
    will be reduced by your earnings that are over $25. In that case,
    the portion of the weekly benefi t amount that you do not receive
    remains in your claim for future use until your benefi t year ends
    (see Item 6 for more information). If your weekly earnings are $101
    or more, the fi rst 25% does not count. The amount of earnings
    remaining is subtracted from your weekly benefi t amount and you
    are paid the difference, if any.

    However, if you were working full-time at the lower paying job, it appears that UI benefits are not payable in your state (that's not unusual, it's the way it is in my state).

    Collecting UI when you are not eligible for it can be considered fraud (if done intentionally) and, even if just an honest "mistake", you can be required to pay it back. Not reading the instructions for over 4 months is not, IMHO, an "honest mistake" Has it gotten that far yet?

    On every single claim form there is a question that asks, did you work - regardless of being paid or not. Why would you check the NO box if the answer was clearly YES?

    I am afraid you have a lot more to worry about then not getting the $450 a week.

    Well, it was an honest mistake. but even with that, I am loosing my second job as of the 16th of this month. I do not care about getting back pay since july till now all I care is that they do not come after me and claim the money thay have given me. A carefuly worded letter will do it but is their free counceling on this type of stuff I can go to get more answers? and can I start a new claim as of the 16th?

    You think a "carefully worded letter" is going to convince the EDD that you "forgot" to enter your weekly earnings when you filed your continuing claims for four months? What color is the sky in your world?

    You'll be lucky if ALL they pursue you for is the benefits you should not have received; they can prosecute you for fraud.
