Hi, I'm new to this forum. Today a speeding ticket of mine was upheld; I was very surprised to see that I was not going to get an immediate dismissal due to the fact that the area I received the ticket in had not ever had a speed survey conducted. Based on this, as was my understanding, the posted speed limits were not legally enforcible, since a speed survey had not verified that the speed limit was within 5 mph of the 85th percentile of the average speed of cars surveyed in the area.
In court I was told this was somehow only valid for radar tickets, and I was paced. If I'm wrong about this, then WHAT governs the creation of enforcible speed limits. They can't just be arbitrarily made and enforced regardless of what the actual average speed of cars is...right???
