    Default Arrest Due to Mistaken Identity

    My question involves criminal law for the state of: Wisconsin
    It was 1:42 am and I was at a bar with friends. While there, I was drinking mixed drinks. I left the bar (walking) to meet friends at another bar. As I walked, I was making a phone call. I heard someone yell behind me and it was a policeman ordering me to stop. He put me under arrest…saying I had set a glass of beer on his squad car. He had been sitting in his squad car watching traffic when someone came up behind his squad car on the passenger side and put a beer bottle on his car. The person that did this then left running and went around the corner of a building. The policeman took off chasing him, came around the corner and saw me and mistook me for the guy he was after. Apparently the suspect was (like me) wearing a dark t shirt, flip flops and tan cargo shorts.
    Here are things that can prove I am innocent:
    The bar I was in has a bouncer, so you can’t take a drink outside. Plus, I only had mixed drinks….and friends that I was with can testify to this. My charge card bill does not itemize my drinks, but I talked to the bartender & he said that there was no way my bill could have had beers on it, as it wouldn’t have totaled up correctly. I tried to explain all this to the cops, and then they charged me with drunk and disorderly and resisting arrest! How do PROVE I am innocent.

    You get an attorney, and you give the attorney a list of witnesses. S/he can get statements, and argue on your behalf in court.
