    Default Misdemeanor Conviction - Greencard Renewal

    Subject lives in Oregon

    Subject was cited and released for theft iii - misd in 5-2001
    DA/court "No actioned" case in 6-2001
    paid fine directly to store

    Subject received perm resident 4-02
    had arrest assault iv F in 5-06 - then DA changed
    charge to crim mistreat I F in 5-06
    pled guilty to Misd Crim Mistreat I - (failure to provide adequate and necessary medical care) in 4-07 with 18 mths court probation
    and successfully completed probation 10-08

    I dont know if this information is relevant or not; Subject is married to American citizen and has one dual national Mexico/America child. Subject has long work history with the State of Oregon and has lived in US since 1994. O has no other arrests or convictions.

    Will subject face removal proceedings upon application of I- 90 for Renewal of his Perm Resident Card?

    Maybe. With multiple charges on the record - including a felony (even though it was dropped to a misdemeanor, USCIS can still see the original charge) - there will be closer scrutiny.

    We cannot guess at whether or not the subject WILL be removed, only that it is a distinct possibility.

    my understanding is the convictions are what are held against the card holder. is that incorrect?
