My question involves a child custody case from the State of: PA
Here is my situation. My husband(NCP) & I have been married for 8 years and relocated to Oklahoma in November 2008. My husband's 2 daughters came from PA to visit us in Oklahoma in July. His oldest daughter(who is 15) decided in the 3rd week that she wanted to live with us. Her & my husband discussed it with her mother, my husband's ex. His ex is the CP. Well after discussing it for a few days, the CP agreed to voluntarily let their daughter stay here. Then a week later, CP changed her mind and said that the only way she could stay with her father is if he would file for custody and go to court. When his daughter found this out, she told her mother that if she had to go to court she would tell. After about 2 hours, we got his daughter to explain what she ment by "if she had to go to court she would tell." She then disclosed to me that her step father has been molesting her for sometime now and that on different occasions her mother witnessed it. We contacted the proper authorities and filed for emergency custody. NCP was granted emergency custody in July, pending a hearing in August. We attended the hearing and the judge granted custody back to the CP, because the CYS worker in charge of the case did not show up. Well, his oldest daughter flipped out about the decision the judge had made. So when that happened, the CP offered to give custody of her to NCP, if he agreed to let the younger daughter stay with CP. So he agreed. Our attorney drew up the paper work and sent it to the CP's attorney for her to sign. We thought that it was going to be an easy process due to everything that was going on. Well, CP didn't agree with some of the things our attorney put in it. So the CP has been working on modifications. It has been almost a month now and the CP is still working on it. The CP spoke with NCP last night to discus some of the modifications. One of which is that the CP's attorney told CP that she can sue me (the step mother married to NCP) if I sign any legal documents. So, my question is...can she do that? I have searched for hours and can not find anything that supports her being able to do that. Please help me!!
