My question involves collection proceedings in the State of: Arizona
Hello,
Sorry many questions here! Ok I had a debt with chase they sold (form what I know) to unifund collections. The debt was a credit card originally and only in my name then I got married. First question is this community property in a.z. Because they are suing my wife and myself? I answered the complaint with the court and sent a copy to the law firm representing unifund. They keep claiming that the s.o.l. is 6 years in a.z. but everywhere I look they say this is a open or stated account which is 3 yrs. in a.z. so next question is since last payment was in oct. 2005 is it or is it not past s.o.l.? And also they have failed to prove that are assigned or even owe the debt dont they have to prove that? And the court set us up for mediation now when does discovery start? I'm sorry but I cannot afford a lawyer and have to go it alone so any help is great. I believe these guys UNIFUND are scum and will do anything to screw people over. I couldnt originally pay the card because I lost my job and it went from $293 to now $2071. I dont know to do this is terrible please help!!!!!
If you added your wife to the card and a joint owner of the account, she's a joint owner of the account. We have no information about what you did beyond marrying.
The date of the last transaction on the account, or the last payment due date after the last transaction, is what?
Sorry if I did not disclose everything I'm just not sure everything to write. My wife was never added to the card. And the last payment received was on oct. of 2005. Hope this all helps. They didnt even know I had a wife until they accidentaly called her phone instead of mine. I think they are suing both of us to attempt to be able to garnish both of our wages.
