    Default Recourse against a workers compensation carrier

    Hello,
    I need help. Is there any recourse that can be taken against a worker compensation carrier that pressured a doctor to release a patient before the doctor or the patient felt the patient was ready to return for work? This early return resulted in the worker being injured in another accident. This second accident caused the worker more serious injuries. These injuries cost the worker a high paying job of ten years and the ability to earn a living in the field that the worker was trained in. This is in the state of Colorado.Thank you for any advice other than to get a lawyer.

    This is a doctor that was treating you, or a doctor that the worker's compensation carrier hired to evaluate you.

    If the doctor responded to the insurance company's pressure by giving you substandard treatment or medical care, consult a lawyer about a possible malpractice claim.

    Thank you. I feel this would be a hard thing to prove. I also feel that my doctor did all he could. He siad that the carrier wanted either a ful release or a evaluation done for mmi? Not sure of that. Either way they wanted the case closed. I felt I would loose this great high paying job if I did not agree to the release. I felt the carrier would have told the company that I would not be covered in my persent position if I had any impairment that would have shown up in the evaluation. This was a very dangerous job that needed great skill and physical strengh to do. I was screwed over from the start with this carrier. They did not even pay the amount that I was due for payment each week. They told me the amound they were paying was all that I was owed. At over 60,000 a year I think I may have received more than 400.00 a week as payment. Anyway, I do feel that I have become disabled because some tart was trying to impress their boss by closing the case early. I will never do the work that I am trained in again. I'm almost 55 years old and can think of no employer that would hire me even without the injuries. No employers want us old people. My guess is I am out the life that I had, my retirement,pension,and at least $600,000. in stock and pay that I would have earned if I had not been injured and worked until age 65. What does everyone think? Am I just another guy that is giong to take it in the shorts or do I have a shot at this worker comp carrier? Thanks again.
