    Default Child Support when Custodial Parent Makes Significantly More Money

    My question involves child support in the State of: Texas

    My husband and I are soon to be separated and divorced, and I'm trying to plan ahead on finances. We have 3 children, all under 10 years old, and I will be the custodial parent. However, I make around $100K and he makes around $45K. How will that affect child support? Does it matter that he could make about $65K to $85K in a larger city, but has chosen his current job because it's a not-for-profit?

    How long has he had his present job?

    How far away are the "larger cities" where he could be earning more?

    He's been at his present job for a year. The nearest city he could make the higher amount in is about 150 miles a way, still within TX.

    Since his employment was a year ago, you will not be able to ask for imputed income. Usually that is asked for when a parent has recently changed jobs primarily to decrease CS.
    Also, the distance would make it more difficult regarding parenting time.

    TX does a straight percentage of the NCP's income. Since the CP makes 100k/yr., doesn't really matter (at least to me) that it's 45k vs. 65k
    If you wanted babies all to yourself, you should have created them by yourself. Until you do that, children have the right to BOTH parents, especially since you found them suitable to procreate with.
