G4 Visa for Overstaying Student Visa Holder

Hi.

I entered the US on a student visa (M) which expired in 2007. I recently got a job offer to work for an int'l organization but will need to convert to a G-4 visa which I will need to obtain through a US consulate outside of the US. Given that I have been out of status, will I have...

a. trouble getting out of the US
b. obtaining that G-4 visa even if I have authorization from the organization that I am qualified for the job
c. is there a waiver / exceptions given to G visa applicants?

With two years out of status, yes, you're going to have trouble getting a visa. I suggest you consult an immigration lawyer with the details of your case to see if you can find a way to salvage your situation.

I consulted an immigration in new york regarding this, and he said that the G-4 visa trumps these restrictions. And so, the bar will not be enforced on you this time round, but a note will be added on your passport that you overstayed the first time round. So if you were ever to apply for citizenship in the US, then you would have to get a waiver for the bar. But all in all, you should be able to get back into the country on a G-4 visa with no issues. Also you will have to go back to your home country for the visa, but make sure the organization sends the proper request to the american mission in your country.
