    Default Who Gets the House - I Can Pay For It, But She Can't

    My question involves divorce in the State of: California
    Heres the problem. We live in california btw.
    I found out my wife was having an affair with someone I confronted previously, and I over reacted. Police were called and now I have a temp. restraining order on our property, which should be lifted in 10 days.
    During this time I’ve gotten a lawyer and answered the orders and did what I was supposed to do regarding the divorce.
    Now the problem is im the sole provider. I pay all the bills, the mortgage and all the extras and she recently quit her job.
    She wants the house that we just bought last year. She has no means to pay for it but I do-but she wants me out of the house claiming she is scared of me. Despite how I feel, she started moving her family into the house while I’ve been on this order.
    What are my options? I’ve called our loan officer to find out what I could do to just get her a loan in her own name and they wouldn’t and couldn’t because her credit is terrible. I tried to find out about selling the house and the market is so low that I’d have to come up with 40,000 to sell it., which I don’t have.
    So what can I look forward to? She wants to go to school full time or what not, while the mortgage gets ignored..what should I do?

    While the divorce is pending, the court may well order that the status quo be maintained, including your payment of the mortgage. If you want something else to happen, talk to your lawyer about petitioning the court for the relief you desire.
