    Default My Ex Wants a PPO in Retaliation

    I acquired a PPO a week ago against my ex for physical abuse and emotional abuse. I am the plantiff in this case. I gave him fair warning that I planned to get a PPO and I believe he thought I was bluffing. He said to do what I wanted and he accepted responsibility.

    So, it took about one week from the time I recieved it (ex-parte) to it being delivered. I'm sure he was shocked and angry and thought I wasn't serious about protecting myself. Because I got the ppo ex parte, he has 14 days to challenge it. I thought he might challenge it, but now I find out that he wants to get one against me. I don't have any clue as to why, except that he feels powerless and wants to get one in retaliation.

    I've been treating the ppo like it goes both ways. I haven't contacted him - nor has he contacted me. I'm not too worried because I know the judge will see this as him retaliating against me and I haven't done anything to worry about.

    I was just wondering if anyone has any information for me or has been through this themselves? I think the ppo system was designed for victims of domestic abuse, and if they actually grant this abuser a ppo against a victim, what does that say about our court system?

    In some states where both parties adequately present to a judge that they were both victims subjected to abuse/threats and there is no clear primary agressor, then the court will allow two restraining orders. I would suggest bringing witnesses to the hearing if possible.

    Well the thing is that I received one for assault. AFTER he was served, he tried to go get one b/c he says I harassed him by writing a letter to his mom (before I got the ppo), and other various things. He's not saying I assaulted him, and his ex parte was denied. I was the one who was assaulted, not him. He's just doing this out of retaliation.
