    Default Different Description on Purchase Contract and Deed

    My question involves real estate located in the State of: Florida

    I purchace a piece of land (1 arce) 8 years ago the contract states 1 arce. The deed states 1.6 arces and the survey was done for 1.6 arces. At the time the seller was like don't worry about it, looks like you got a little extra. I have be paying taxes on 1.6 arces for 8 years. Now, it seem to be a issue as the seller, and the seller wants to redo the paper work now to reflect 1 arce, or have me buy the extra .6 stated on the deed. Do I own the .6 since it was on the deed, on the survey paper work, and I have been paying taxes on it? Or does is contact legel binding me to only the 1 arce?

    You purchased whatever was conveyed to you in the deed. Verbal stuff is a "no no" in real estate transactions and usually without effect due to the statute of frauds.

    Your transaction sounds like a typical sale in gross, which means you bought the property described in the deed, assuming it can be traced on the ground by a surveyor from the deed description. In that case, the acreage in the contract of sale is of little or no importance, and the terms of the sale contract are likely "merged" out of effect upon the delivery and acceptance of the deed by you.

    I'd tell the guy to pound sand, in other words.
