Default Being Sued for Credit Card Debt
My question involves collection proceedings in the State of: Illinois
I make about 500 dollars a month in my part time job and I am being sued for 4400 by a debt collection agency that bought the debt from capitol one. I also declared bankruptcy 7 years ago so cant do that yet. I was served with the summons about 7 months ago and have been to court 3-4 times. The law firm that is suing me is in chicago,but they are having a local peoria lawyer handle the case so far. He keeps showing up and filing continuances every time.. Then all he does is approach me every time and ask if im going to pay and I tell him no that i cannot. He keeps coming up with excuses for the contineuances and the first time,i signed voluntarily and then the last two the judge made me sign,even though i want to get this over with. I forgot to mention that this is in small claims court. We actually have a trial date for sep 2 scheduled. The last time we were in court the lawyer and the judge asked me if this was valid and I told them that I am not sure,as i walked away from 6-7 credit cards about 3 years ago. The lawyer wanted the next date in oct or nov as he said he has to get all the lawyers from chicago down here for the trial. The main question that I have,is he really bluffing, or are they really going to send a couple of lawyers from chicago down here. They have already spent at least 600-800 dollars and they would have to spend probably another 1000 to keep pursuing this. I have no assets and cant believe a company would pursue it knowing they will get nothing. Also can anyone tell me what actually happened in the trial part.. The judge told me to have my witnesses prepared,but I dont have any kind of case besides standing there and telling them Im not sure if its my debt or not. I know I owed cap 1 but I dont know if they actually sold the debt or not... Thanks for any help of anyone thats actually made it all the way through and what happened....

Here's an explanation of small claims trials from Lake County. You can check to see your county's website to see if they offer something similar.

Today i got court papers from the law firm suing me that say they filed a motion to dismiss with the court and the court has approved it... Does this mean that its finished???
We had a court date scheduled for sep 2....From what I understand is that they are dropping the case... Is this right???

You better check that with the clerk of court, with those "law" collectors "firms" you never know.
