    Default Do Arrearages Have to Be Paid on

    My question involves child support in the State of: Texas

    Taken back to court last month to have non-custodial parents child support payment decreased due to decrease in income. He is currently paying $708/month($108 is towards 17000 that is past due!) Payment decreased to $608( current support $440/ past support$168). I am only getting $440( amount without past support added) a month. How is employer able to do this and not pay ANY on past due amount? They were given new modification papers. I know they cant take over 50% of income but that shouldnt be issue since i was getting about $600 month since jan09. (he was never able to pay the full $708 due to fact it would be over 50%.) So now payments have decreased and now not even paying on past due!! How can they do that and who deceides

    What do you mean, "How is employer able to do this and not pay ANY on past due amount"? The non-custodial parent pays support.

    If you're stating that they've made an error processing the paperwork from a new income withholding order, try having it resent.

    Do you have a copy of the income dedution order? if not you need to get from your lawyer along with copies of all documents regarding your case..your intitled to it (if he's been payed)

    if the amount you recieve is differant from the "INCOME DEDUCTION ORDER" Then file contempt charges against the employer and the non custodial parent. not sure about your state but, if the employer doesnt follow the order they can be fined

    If the "income deduction order" is different from the court order inform the clerk of court or your lawyer of the error and ask the clerk of court or your lawyer to send the correct income deduction order

    (non-custodial parent is putting himself farther behind in arrears)
