Rear Differential Leaking Tons of Fluid

I live in Oregon.

I just bought a used car, and i asked the sales men if anything is leaking and he said no, they also said it got a new rear differential recently.
A leaking rear differential may make the car not run and cause an accident if it fails while driving, does the car dealer have to fix this? or am I SOL?

What were the terms of the purchase?

If you're purchased it as is, the onus is on you to fix it. If it was sold as "certified", the dealer is on the hook.
