Default Getting a Lien Against a Subsidiary of Debtor Corporation

    Hi

I got a default judgment against an Inc. The Inc. has an LLC. Can I put a lien against the LLC, since I would think it is an asset of the Inc.? Or do I need to modify the judgment to include the LLC.

I'm not sure exactly how to proceed. If the Inc. has bank accounts or cars, etc, other assets, I can file a lien against it. So my question is: Is an LLC and the assets of an LLC considered an asset of the Inc. which owns the LLC.?

Thanks in advance for any advice.

Default Re: Getting a Lien Against a Subsidiary of Debtor Corporation

If a corporation has a wholly owned subsidiary, the subsidiary is an asset of the corporation. The structure may make it more difficult to pursue the subsidiary's assets, as opposed to the shares or other interest held by the parent - that's not something we're in a position to answer for you.
