    Default No pay after being fired

    My husband makes 575 a week salary. He got fired on the 7th for being sick even tho he had a doctors note. The 8 th he was supposed to be paid for that week and the previous week. His employer never pays the last paycheck to people when they quit or get fired, my husband knew that after working there for 5 1/2 years, so he told his employer he knew the law and wanted a check.

    Went and picked up his check, and taxes and everything were taken out and the employer kept the rest...he got a check but it was for 0.00.

    we notified the labor cabinet, can they get his money, or will we have to get to court to get it??

    Default Unlawful Withholding of Wages

    You should pose that question to them, or if you prefer to a local lawyer familiar with their practices.

    If they don't recover your money, you may have to sue. Most states permit recovery of attorney fees in association with violations of wage laws (and unlawfully withholding pay would be a violation). There may also be a federal claim under these circumstances. If you get the pay and are satisfied with that, you may wish to let sleeping dogs lie. But otherwise you should discuss this matter with a local lawyer who handles employee wage claims.
