    Angry Assault on a Minor by an Adult

    A week ago, I was attacked by a 20 year old. (I'm 17)
    He hit me in the face (sucker punched) and I now have:

    Fractured Jaw Bone
    Fractured Facial Bones
    Skull Fractures
    Two Blood Clots in my head
    Internal Bleeding
    A burn on my arm (from landing on the pavement)
    and... A Lazy Eye (I don't know if it is permanent or not)


    I just want to know what he can be charged with.

    Of Course... Assault on a minor...
    Maybe Attempted Murder/Manslaughter.

    I know that I can sue him for A LOT of money, because the medical bills came to like $15,000 or more... I just need to know how much he can be punished (to the extent of the law)

    You don't mention your state, nor do you mention any facts. Contrary to what many teens believe, there are cases where a minor (esp 15-17 year old) CAN be legally struck (self defense, and other mitigating circumstances)

    I live in Missouri.
    And I was punched for no reason at all and I didn't even pick the fight (if it can even be called a fight). It was simply out of nowhere. I didn't even know I got hit until a day later, when I woke up in the hospital.



    So.. what do you think?

    The police officers who took the original report will turn the case over to the DA. IF the DA presses charges then they will talk to you and let you know what punishment they are seeking.
    You DID make a police report, didn't you??

    Oh yeah. He was arrested right after the incident, but they let him go. My mom is taking care of all the legal stuff, I just want to make sure she knows what she is doing.

    (Fun Fact) When the police went to arrest him, his older brother came outside and started crap, and got TAZED four times. Lol.

    I don't know whats taken them so long to issue the warrant... but I hope they do it soon.

    If they already released him, it could be that he has another court date already set.

    If the injuries are that obvious, and if the circumstances clearly offer up no legitimate self defense claim, then this may be relatively easy for the state to prosecute.

    I am Brett's (the 17 y/o) mother. The 20 y/o hit Brett and was picked up by the police, he admitted to his actions and that it was unprovoked. He was arrested, booked and release as this is the procedure. He was released pending charges. At the time of arrest, the extent of injury was unknown.
    Brett was transported to the local ER by ambulance. A CT scan showed 2 skull fractures, 2 hematomas on the brain, and facial fractures. He was then air lifted to St. Louis Children's Hospital, where he spent 2 days in the ICU.
    Since being released from the hospital, he has some facial droop, visual disturbances, loss of depth perception, and some balance issues.
    One comment by the authorities was that the charges would increased based upon the injuries and medical bills.
    A report was filed the day of the assault, and I took Brett's statement in a few days later. That day, the officers told me that the guy would have a felony charge and that the warrant would be issued in a day or two. I have been checking CaseNet and haven't seen this guys name yet.
    There were many witnesses, including some construction workers that were right across the street.
    I'm wondering if I need to contact the DA or just wait until we hear from them. I had the medical records faxed to the police department.
    I also fear retribution from the family of this man. His brother did in fact attempt to attack officers when they showed up at his house.

    You can certainly contact the police or the DA, but I imagine they are already working on it. If they proceed before they are ready, there could be problems in the prosecution. But, call and find out what might be happening.

    It is not unusual for felony cases to take awhile. I have seen felony cases that were fairly simple take over a year to go to any sort of trial.

    In mean time request a personal protection order for your son through the courts.
