    Post Child Support

    My question involves child support in the State of: Florida

    Me and my ex were divorced in 1997 and he was ordered to pay childsupport directly to the courts. he always sent me money instead of going through the court. they are showing him in arrears and he is contesting it, he has blank money order stubs saying that they were for child support given to me. there were only a few hand written reciepts made out by me, the rest i cant even say i recieved. I have to go to court on this Friday and my question is do i have to give him credit for those receipts, even though (A) i dont know they were all given to me (B) he never helped with anyother costs associated with my childs care (i.e. insurance, day care, school expenses, clothes etc.) i have carried insurance on my child since day one.

    What does your court order state regarding how the payments were to be made?
    Typically, if the order specifies the payments be made through the court, or state disbursement unit, anything not paid that way will not be credited. I know that was put into court orders after 2000, but I'm not sure if it would have been included in an order from 1997 or not.

    You should agree to any payments that you know he made, the Judge will decide if he is credited or not.

    Typically, his portion of the insurance and day care costs should have already been added to the basic CS. If it wasn't, you might need to file for a modification to have those added.
    As for the school expenses and clothing, unless they are specified in the order, CS is supposed to help you cover those expenses.

    The order states it was to be paid directly to the clerk of court

    Also i dont know what receipts went to me because they were blank and he was so spuratic with his payments and he shouldnt get credit for what i didnt receive So can i instist he prove that I cashed them in order to prove which ones i received
