    Default Copyrighted Graphics Files in a Game

    Well we are having this big issue on these forums : Forum.endless-online.com
    About how a artist from the game is claiming copyright infringement, on this new "emulator" or "privateserver" for the game. The owner of Endless-online.com doesn't seem to have any issues with these emulators and has not taken legal action but has acknowledged the servers exist.     "Arvid" is the artist who is now claiming that all the emulators must be deleted for taking his art work that is implemented in this game. And my question to yous guys is how much legal pull does he really have? Could he take this to a court? These servers are hosted all around the world now, and he is in the nietherlands. . . if that matters.

    He might have some argument. But it sounds like fair use.

    Not going to bother to read the thread. Could care less.

    In any case, I would bet the artwork is not registered in the U.S. Copyright office and he has no money to hire attorneys, and then sue people here or all over the world. People who I would guess do not have much anyway.

    What injury or damages could he ever prove? None I am sure.

    His ego is hurt, he hasn't gotten enough credit, or he just wants to shake people down for some bucks.

    This is not a legal opinion. For that you need to hire an international intellectual property attorney at about $750 an hour.

    You could all probably buy him off for less than that.

    Laws are different in every country in the world. His chances vary depending upon the laws of the country or countries where he takes action. In the U.S., his easiest tack would be to use a DMCA take-down notice.
