    Default Can I Get Emancipated?

    I am 15 years old.
    I have 50,000$ in my bank, I have a job that pays $30 an hour.

    I currently live with my mother.

    Here is my situation.
    She is forcing me and the school district to put me into advanced biology clasess. She is forcing me to be a doctor, and I dont want to become one. If I do not get straight A's, I am going to bording school.

    I am doing horribly in these classess she is forcing me into. My councelers have all tried to explain to her, that these classess are not for me, yet she caused a lot of trouble at the school and made me get into them. My GPA is low because of this, I am basically setup to fail.

    Its my life she is ruining, and it is my life I want to live.

    I want to live on my own, and support myself, pursue my own career, and practice what I'm good at.

    -Would I need my mother's consent to get emancipated?
    if My mom does not agree to let me be emancipated, could I do this in court anyways, or who would I have to talk to about this.

    -Do I absolultly NEED a lawyer, or can I just represent myself?

    -How long does it take to become emancipated?

    -During the emancipation process, do I have to stay with my mother, or can I stay at a friend's place.

    -The fact my mother is physically abusive, would that help?

    -Is this ok, I plan on staying with a friend during the process, and after the emancipation process - until I can find a place of my own?


    Is there anything else I should know? Who do I contact to get emancipated. Is there anyway I can do this without going to court, and without my mother's consent?

    Not in California.

    You can represent yourself; but you can obviously afford a lawyer, and should consider hiring one to represent you, particularly if you think your parents will oppose the petition.

    Win or lose, it will probably take at least a couple of months.

    Until you are emancipated, you remain under your parents' control. If you are able to set up a residence independent of your parents, it would probably help you with your petition; but it doesn't sound like your parents will sit by quietly while you attempt to move out.

    Possibly.

    If you successfully establish yourself in an independent living arrangement, that generally helps with emancipation. However, it also helps for the arrangement to be stable and long-term.

    You commence a legal action for emancipation in your county court.

    It is possible to live independently as a minor without emancipating if you have parental consent, but you obviously don't.
