    Default Tenant Changes Mind on Lease

    Hi,

    I have a property in NJ. Here is the situation.

    Tenant signed lease for the 15th of July (one year).
    Tenant has paid pro-rated first months rent and security deposit.
    I let the tenant have the keys a few days early because of the weekend to move in.
    As they were moving in, there was a disturbance in front of the property.

    They now want to void the lease and not move in.

    Am I entitled to keep part of the rent of deposit while I search for another tenant. I would not want to force them to take possession as this would be a bad start to a tenancy.

    They can not just "void" the lease. You are entitled to rent for the duration of the lease or until a new tenant is found.
