    Default Unpaid Day of Work then Fired

    My question involves independent contractors in the state of: Ohio

    I have an employer who refuses to pay me, I came in contact with his Landscape Company through Craigslist, he told me to come in at 7 am on June 12. I worked until 8 pm. At the end of the day I was told I did not have what the company was looking for and that they would mail my check to me. I gave them my address. Weeks later I have not received my paycheck, I contacted the employer who said it was in the mail. Another week or two has passed and nothing what should I do? Is this even worthy of small claims? The agreement was $10/hour so therefore $130.00.

    Small claims would be the way to go.

    I didn't want to answer this one too, not really my area of interest or expertise. However, so many lame answers to stuff do I see, I am compelled to mention a few things. Sometimes it pays to be creative.

    Depends on the time you have and how mad you are. I hate being ripped off.
    I never let anyone get away with it. I just signed settlement papers today for 11k and in a few weeks will be starting a civil action for 5 million, and I recently destroyed (for very good reason) our state attorney who lost re-election thanks to me. A couple of months ago I sold a little complaint website for 3K.

    There are labor laws on this sort of thing. Do some research. File complaints. File a complaint with BBB, area chamber of commerce, attorney general, state attorney, anyone you can think of. Your complaint alone might not do much, but cumulative complaints can get his rear in a sling.

    Also, if his business requires licensing, check out his license and file a complaint with the licensing board. Check his legal status, etc.

    Go on craigslist and flag this guys ads. Let Craigslist know he is hiring people off the site and then ripping them off.

    Follow him around for a few days (safely) and make note of his customers. Then start leaving neatly photocopied warnings about how he rips off his employees at each customer location. I would mention that if he rips off his workers, what is he doing to his customers? A little creative writing can go a long way.

    Yes, you can go to small claims, but you have to prove he owes you the money. You have the burden of proof. Unless you can meet that burden well, you will just be wasting the filing fee.
