    Default Rear Ended by an Uninsured Driver

    My question involves a traffic accident in the State of: Texas

    I was recently rear ended by a driver, no injuries involved but my car got smacked pretty bad from behind. The other driver doesnt have insurance and nothing happened to her car...

    I called cops to the scene and they immediately kept her "at fault", report etc. I am going through my insurance now to atleast get the repairs started. I have collision/comprehensive but NO uninsured/underinsured coverage. So, I am having to pay the deductible out of my own pocket...the other driver is cooperative but she doesnt have any MONEY to pay for my deductible or my insurance co...she says she can only do "very small monthly" payments which is going to take 3-4 years to get back the money...

    I also had to rent a car (I didt have rental insurance...) which is liable to pay too...right?

    My question is what are my options here to get the money fast (my deductible and car rental))? She doesnt have money to pay but drives a big car and lives in quite a decent house (saw it on google maps from her address)...HELP PLS...

    Was she cited for being uninsured? If so, you may be able to make a restitution claim through the court.

    Otherwise, you're looking at small claims court - faster than most litigation, but not exactly fast... and then you have to collect the judgment.

    I'm in a similar situation and would like to avoid small claims court. Is it possible to file a restitution claim for an auto accident like this? I thought that was just for crimes. I was rear-ended by an uninsured and unlicensed driver and I'm sure he was cited for both offenses.
