    Default New Order For Child Support Arrearages

    California and Texas, 2 of the biggest, most overstuffed child support bureaucracies and I would imagine the 2 biggest messes in the nation.

    Anyway, I owe my ex-wife chid support arrearages. I owe no money to any state or county. My child has never collected any public assistance. All arrearages are owed to my ex-wife. My child is emancipated.

    I live in California my ex-wife lives in Texas. The Texas courts have jurisdiction in this matter. Texas contacted California and California garnished my wages for $100.00 per week.

    I did not agree with Texas on the amount that I owed. My ex-wife and I went back to court, agreed on an amount and reached a new agreement. The new order was filed in the Texas Courts on Dec. 29, 2005. In this new agreement, I am to pay $50.00 per week until the arrearages are paid.

    Texas has corrected their records to show the new and correct amount, which says I am to pay $50.00 per week. California is still deducting $100.00 per week. I have given California a registered copy of the new order. California says they need a registration statement from Texas. I have made numerous phone calls to Texas, I have sent letters and emails to Texas and so has my attorney. Nobody from Texas will answer me, nor have they answered my attorney. San Diego County Child Support Services has conntacted Texas and Texas has not answered SDCCSS either. Texas has not sent a registration statement to California, nor will they tell me if they intend to send what California is requesting.

    What do I do, any suggestions? Do I have to spend more in attorney's fees to haul one of these states back into court? If yes, who do I haul into court, Texas or California?

    Just what do I do to get California to deduct the correct amount from my wages?

    I think you need to get an exemplified copy of the order from Texas, and file it with the court which issued the Texas support order under that case and case number, then bring a motion before the Texas court asking that it be honored. If you are uncomfortable doing that yourself, then you might be stuck hiring a lawyer.
