Default Overweight Ticket
My question involves a traffic ticket from the state of: California
not sure what section to post this new thread.
I got a ticket for carrying more weight on my truck than my permit allowed( I was over by 7.000 lbs) i went to court with my new and correct weight limit and registration sticker but it did not matter. I plead no contest and got a fine for over $7.000.00 dollars yes that's SEVEN THOUSAND DOLLARS. i filled a appeal and now I got a letter from the court that i have to go to my Appellants Opening Brief July 10 . my question is what is this opening brig about should I get a lawyer? can i file for an extension? please help asap

A buck a pound seems a little harsh -- you must have really ticked off the judge....

That aside, please contact an attorney -- TODAY, if possible. You are probably in WAY over your head. The Appellant's Brief is NOT an appearance -- it is a paper you must write and file with the court BEFORE the 10th. It lays out the basis for your appeal, assignments of error, and authorities (case and statutory law) that support your reasons. If you fail to do that, your appeal can be dismissed.

Contact an attorney that has some knowledge of appeals. They will know how to request an "extension of time" for filing the brief.

What is the basis for your appeal? You MUST find error with something that the court did or did not do. Simply not liking the verdict is NOT usually grounds for an appeal.

I will get a lawyer TODAY!!!
true I'm over my head with this mess its just that 7k is a lot of money for me.
when I went to court i plead NO CONTEST can a lawyer still help out?

"Where am I going? And why am I in this handbasket?" SO TRUE!!

NOTHING SCARES ME MORE THAN HAVING TO DEAL WITH THE COURTS
by the way I did not do a thing to the judge, just plead no contest that's all no comments or anything. the whole thing took less than a minute. I found out how much it was when I went to the cashier.
