H1b Transfer - Validity of New I-797

Hi,

My H1B is due to expire in Sept 09. I had filed for H1B transfer in Jun 08. However, I have not received approval yet. My employer is going to file in premium soon. I want to know if the new approval (if approved), what is the validity period. Is it also going to be valid until Sept 09 ? In that case I may not get sufficient time to file for extension, so I want to be prepared. Thanks for help !

If, for example, your employer has requested a three year extension and you have three or more years of eligibility remaining, you can expect to get a three year extension. (But we don't know how many years you've been on H1B status, or what your employer has requested.)

The key for your status is that the employer applied for the extension in a timely manner; although if he files for premium processing within the next couple of weeks you should get a formal answer before September.
