over the past 3 years, myself and my family have been bullied by my next door neighbours. My family are private owners of the house, and my neighbour is a council tennant. It all started with the fact that my neighbour believed the ginnel belonged to him. He could have been easily mistaken because the ginnel pathway merged with both his front and back garden.
However, in my house deeds, it states that the ginnel is freehold and belongs to me. I have confronted my neighbour about this, but he would not listen to me.
Since then he has been abusing the use of the ginnel. When we returned home from holiday, we found the shared access brick wall was taken down, and was used for my neighbours garden barrier. When the council put up a 6 foot fence, my neighbour was then allowing his dog to run up and down the ginnel, doing it's messes and would be left there for some time. My neighbour also likes to bang against my side of the wall with a broomstick when he cleans the ginnel. Also when he cleans the ginnel, he either brushes it against my wall, causing dampness and damage to my wall, and also throwing it over my back garden fence. I could continue with other issues, but it would take up too much room.
My question is this - am I able to terminate the the contract my neighbour signed for right of access in the ginnel? If so, how can I do it? Would I need to include a lawyer, or would I have to go to court?
