Default Florida Credit Card Collections
My question involves collection proceedings in the State of: Florida
I am currently in the process of trying to settle a debt with Capital One which I defaulted on in October of 2006. I was served with a summons to file a written response in June of 2007. I replied in July of 2007 and did not get any reply until May of 2009. According to my card member agreement, my account was governed by Virginia Law. Has the statute of limitations expired and can I request dismissal of the debt based on this?

What exactly does that mean? What "answer" did you get? Do you mean a judgment was entered against you in May, 2009?

If you were sued less than a year after you defaulted, quite obviously they were not late in suing you.
