    Default Re-Trial and Appeal

    My question involves criminal law for the state of: Pennsylvania

    Good morning! I have a general question...I have a boyfriend that recently got sentenced 3 1/2 - 15 years, and he is thinking about appealing it to get a lower sentence and get another trial. Is this a good or bad idea? Or do you think he will get more years for being selfish? I guess my question is: If he gets a new trial can the judge give him more years?

    If his conviction is reversed, he gets a new trial, and is again convicted, he could conceivably get a greater sentence. That's something he should discuss with his criminal defense lawyer.

    We don't know if he has any issues to present on appeal. He needs to talk to his criminal defense lawyer, or have his case reviewed by a criminal appellate lawyer.
