Question Credit Card Summons
My question involves collection proceedings in the State of: CA

I received a summons today for a unpaid debt over $25,000. It says I have 30 days to respond from the date I was served. It is filed as a Civil Case (Unlimited) Contract=Other Collections, not a class action suit, it also mentions "common counts", and on the last page it says it is in the delay deduction program.


I am wondering what my options are (fight it and hope it gets dropped (how to move forward), settle, or file Bankruptcy, etc...) And if I am forced to go the bankruptcy route will I lose my house/vehicles/personal property? Thank you for the advice!

We know nothing about your financial situation. If you're considering bankruptcy, consult a bankruptcy lawyer. Your lawyer will review your situation and make a recommendation as to Chapter 7 or Chapter 13 bankruptcy. The initial consultation is typically free.

Similarly, you've told us absolutely nothing about the lawsuit, save for the amount they're claiming. If you owe it, and they filed before the statute of limitations ran, the most likely outcome is that they'll get a judgment against you.

With bankruptcy are you able to keep your house and vehicles? Currently I am in no position to pay the debt back. I had been paying my monthly payments until hey increased the amount from $200/mo to $800/mo. at that point it was either pay on the credit card or pay my mortgage, I choose my mortgage. Also what is the average cost range for bankruptcy?
