    Default Child Support While Disabled

    My question involves child support in the State of: New Jersey

    I am 61 years old and have been disabled and collecting Social Security for about 6 years. I also collect a small, $140, check from the VA. While I was disabled I received a settlement related to my disability. I had to pay a portion of that amount to the courts for child support. Not a problem! However, all of my children are grown and out of the house and I am still getting every additional government payout taken from me to go to child support. When does it all end? I tried to find the laws related to being disabled and paying child support, but could not find any discussion. Does anyone know if you are suppose to stop paying child support when 100% disabled? Your thoughts and knowledge are appreciated.

    Yes, CS can be ordered even if you are disabled.

    Do you owe any arrears?
    If you do, the garnishments might be paying the arrears.

    If you don't owe arrears and all of your children are over 18, you'll need to file to stop the CS.
    If the state CSE agency is involved with your case, you can speak to your caseworker about stopping the support.
