    Default Shop Performed Poor Work

My question involves a consumer law issue in the State of: Nevada/Arizona

    Hello

I recently got my vehicle worked on by a performance company in Arizona and I live in Nevada. I took my vehicle to get a turbo system installed onto it. I took my car to the company on April 16th 2009 with the completion date of May 2nd 2009. I paid the company in full at time of drop off of my vehicle to them. They proceeded with installing the turbo set up that they manufacture. The kit was a standard kit and was only gonna take a couple weeks to do, and be finished. The cost of this kit was $3365.00. During this process I was never kept informed with the status of my vehicle unless I called them, and got some answers i needed. I was also told by them that they installed a custom exhaust that I never asked for but was free of charge for some reason. I was told the car was done and I purchased plane tickets to go down there, the day before leaving I contacted them to give them my flight plan and they said that the car was getting tuned and the axle boot ripped. This then needed a new axle, and the car was still being tuned. This to me says that the car was not done in the first place even though they said it was. I told them OK and they fixed the axle and they went back to finish tuning the car.I already purchased the plane tickets in which I couldn't refund so I lost $100.00 there. I then contacted them again to check the status and they said it was done, so I purchased plane tickets for me, and two friends to go get the car. When we got to Arizona on the 7th of May 2009 we went to the shop and my car was still apart and being tuned. I guess my car was not really done even though they said it was AGAIN. During our wait for it to finish tuning the clutch was slipping so they couldn't finish tuning it with out installing a new clutch. I said OK and left the car there to get the new clutch and finish tuning. I discussed with the shop about the clutch I was getting from them and they said it was a Stage 2 clutch and I agreed that would be good. The shop took us to a rental car place and I had to rent a car to get back home. The plane tickets and rental car cost me $250.00 for this trip down there. The clutch got installed after waiting for 2 weeks for the clutch to show up. This cost me $606.00 for just labor, but they got it installed and were going to finish the tuning. I contacted them again to check the status of my vehicle and they said they were having trouble tuning it. I continued to contact them and had nothing but the same answer " Having trouble tuning it" I asked them what was different on my car since they have done other cars just like my before with this turbo kit and they said nothing is different. I said ok and let them get back to work, contacted them again and again with same answer as before. I asked them 3 more times what was different and they said nothing but I found a forum that they posted on that said everything was different on this kit. They finally admitted that yes all that was different on this kit but it shouldn't make a difference on my car. I said ok when is my car going to be done and they said that they are changing a couple things and then retune it. they said it was tuned as good as it can and its safe to drive. I said ok and I need my car back by Thursday June 18th. They said book the ticket to fly down. I booked the ticket which cost me $150.00 since it was last minute and flew down there to get my car. I got to the shop and they pulled the car around to me and we talked. I asked them if it was good to go and they said its not perfect but its safe and will be fine. I got in my car and started driving when all I hear is bang, rattle, pop, rattle. I checked out the car and the piping was rattling around, the exhaust was banging off the floor, Etc. I talked to the shop and they zip tied the pipes up, didn't even care about the exhaust, and I had to tape up holes in my intake so I didn't get dirt in them. The clutch felt wrong and was whining, they said it was a stage 4 clutch and not the stage 2 that we agreed on. The whining sound was the clutch bearing which they replaced. the shop didn't seem like they wanted to fix anything so I decided to drive it home so they couldn't mess anything else up. While I was driving the check engine light came on, parts fell off going down the road. I pulled over to fix all this and the car was misfiring and backfiring. I got the car home and looked under it. The engine had oil leaks, loose pipes, bolts missing, alignment off, exhaust melted part of my bumper, car wont stay running, basically everything was wrong. I contacted the company and they said that it wasn't done and that they would fix it if I took it back to them. I told them im not taking it back o them in fear that it my get messed up more if they touch it again. I told them that they said it was as good as it will get and its safe to drive. Now at this point I would just like my money back and the car put back to stock condition. This will cost about $1600.00 to repair the car and the refund from the company would equal ruffly $4471.00 with out the repair cost of $1600.00. This would total up to be $6071.00, also there are about 10 more people with this same issue of trying to get refund for stuff they never got or are still waiting on. Some of these people have been waiting over 600 days for there stuff (yes 600) I have a broken car and the other people don't have parts.

All in all this company took 3 times as long to give me my car, used different parts then stated, never kept in communication, performed work not requested (free), and the job is incomplete and the car is unsafe to drive.

If this company fails to give me a full refund can I go after them for the amounts above. I would need to know ASAP so I can begin the legal process if needed.

    Thanks

    Chop

Sometimes repairs take longer than expected. It's hard to say what a court would make of your plane ticket costs.

You also don't necessarily get a refund. Let's say you pay a company $3,365 to upgrade your car, and they do it wrong. You go to another garage and they say "We can fix it for $1,600." Your damages in relation to the work itself would be the $1,600 you paid to get the car fixed.
