    Default Speedy Trial Rights and Self-Representation

    Two and half years ago I was put on bond for misdemeanor battery in WV. My court appointed lawyer has refused to defend me since I would not accept a jury trial, the court has refused to appoint me another lawyer. I filed motions to remove the magistrate and prosecutor since my lawyer wouldn't. The circuit court judge told me that when the court and it's officers had finished their business then my motion would be heard. Well it's been two and half years and the statute of limitations on a speedy trial has come and gone and still the court will not hear my motions since I am representing myself, and am not an officer of the court. Since I am representing myself wouldn't I be an officer of the court or is it allowable to discriminate by representation? Well I want a lawyer who wants to defend me and then sue the lawyer,court, magistrates, police, county,and state for violating my rights. This is not the first time I have been held in this limbo by the same court for the same reasons, last time it was for one and half years. I will consider all offers. Leave contact info...

    If you unreasonably refuse to cooperate with your court-appointed lawyer and insist upon representing yourself, then you very often get just that - you end up having to represent yourself. You remain free to hire a lawyer of your choosing. You don't seem interested in having the court appoint a lawyer to represent you; if you are, petition the court to appoint a new lawyer.

    If you look you will see that I asked the court for another lawyer. The self representation is becuase the court appointed lawyer and the court refuse to consider my motions and participation in this case. Both which are my rights. A jury trial is the quick way for the court appointed lawyer to get paid and not really represent me.It also stops the speedy trial time limitations....(do not let a backwoods country lawyer represent you unless you want to go to jail) I've been through 53 criminal court cases and never convicted of anything but one traffic ticket in traffic court. I am not a lawyer but do understand how the system works, I am looking for a greedy ambulance chasing lawyer or a smart greedy lawyer becuase only they will be recognized by the court.
