Default Sears account past due
The sears account I have in my name I have had for a number of years now. I got it in my name when I was first married becuase my husband's credit was not good at the time... I know why now. Anyway he charged things on the card and all was fine for awhile. He said he would be soley responsible for making the payments and was for a long time. Anyway to make a long story short, he stopped making payments, would get the statements and throw them away, and not answer the phone calls from the credit dept. We have since seperated and I am stuck with the bill. It's about $1,400. Is there anyway of getting out of this debt? I finally spoke with a creditor who was very rude on the phone and it sounds to me that it is going to some kind of possible court proceedign although I have not recieved anything yet, but I can not afford to pay it of as they would like, and am worried about the legal aspect.
What do think I should do??? Thank you.

Default Divorce?
If you are going to pursue divorce proceedings, you can try to get it satisfied from the division of the marital estate, or make your husband responsible for the debt as part of the divorce judgment. But the creditor will still go after you until the debt is resolved.

should i at least start paying something on the account say $50.00 a month or more when i can and will it keep them from legal proceedings against me???

Are you still dealing with Sears, or has the account been passed to a collection agency? If the account is still open, you should be able to make the minimum monthly payment to keep it out of collections or court.

I believe it has gone to collections. I have some guy calling me at work, and leaving me messages with alot of legal sounding jargon.
I spoke to him once and he said they would stop all further proceedings if I could pay $1400.00 and then we would be done. well if i had that kind of money i would, but i don't, so he said they will just have to proceed with legal matters. What now??

You can try to work out a payoff or payments. Otherwise, they will continue to try to collect.
