    Default Domestic Violence, Divorce, Risk of Deportation

    charges filed in Michigan.

    just for the record i am not here for myself so i dont know all the details.
    im here for my cousin (male). this may be a little biased

    he was born in macedonia, moved to england, than came here to america on a visa or something and simply just stayed here illegally(i think).

    he got married to some crackhead chick and quickly after tried to get a divorce, i dont know if it went threw or what happened. this girl was a real nutjob, didnt want to leave him, wouldnt leave him alone, stalked him, called him repeatedly and most importantly threatened to deport him.

    he couldnt hide from her in michigan so (this doesnt make sence to me) he moved in with her and was living with her to "make her happy"??? or something like that because she was threatening him(she is that messed up). he realized it was retarded and fled to another state where she couldnt find him . now, he got pulled over and found out that he has a domestic violence charge on him in michigan and there is a warent for his arrest, he got arrested and then for some reason they let him go (like i said i dont know every detail)

    he asked me to help him look for a lawyer online.

    now, this situation is really really bad because if it goes the wrong way he could get deported correct? also, i understand it is really bad that he left the state but he did not know of the domestic violence charge. when he got arrested the cops also said he had a "pending" charge on him that could be bad, the deportation?

    from what i read online, the domestic violence charge is not a big deal because he can always file one right back at her and make a big mess of things that most likely wont go anywhere but the possibility of deportation is a problem that i don't know anything about

    what is the best way to handle this because i know there is no way to drop the domestic violence charge and he is considering going back to macedonia by himself if its going to happen anyways in order to keep the possibility of re-entering the country at a later date. but then again i dont think that will help if he has an outstanding warent.

    please help!

    You can't make a domestic violence charge go away by, months later, trying to file one against the alleged victim. Nobody would take that type of retaliatory accusation seriously.

    He's dug himself a giant hole, so I suggest that he enlist the help of a criminal defense lawyer and an immigration lawyer. He may be able to avoid a conviction on the domestic violence charge by taking a deferral, and if he's lucky the court will accept a no contest plea; or he can take the case to trial and see what happens. It would appear that he's been out of status for an unknown amount of time, has been failing to keep the USCIS appraised of his address... and supporting himself by working without proper authorization?

    well....it hasnt been very long since the charge was filed, i think it was filed at the end of may.

    he has a driving licence in his name, but as far as having a registered address and what not with the USCIS or w/e, no. and he managed to get jobs that pay him in cash, just like every illegal in this country.

    the main concern is if his nutjob ex-wife's threats of deporting him have any truth to them. or if he goes to court will he get deported.
