    Default Arrested Twice for Theft

    My question involves criminal law for the state of: Texas

    I was arrested a few months ago and charged with Felony theft 1500 to 20,000. I was not intending to steal anything. I was at circuit city and they were so unorganized because they were going out of bussiness. I asked several employees for help and was just left sitting there. I wanted to make sure the TV I was getting would fit in my car, so I took it out front, eventually I fit in my car, returned inside the store (leaving my car right outside the doors of the store) to finalize the transaction and clarify some warranty issues. While I was discussing this with customer service, two officers came in and arrested me. I explained the situation, but they arrested me anyway. I spent a night in jail, bonded out for a $1000 dollars and now have a lawyer who is helping me resolve the situation.

    Unfortunatley, two days ago I was arrested again. This time I was charged with Class B Misdemeanor Theft $50-$500 because the guy I was with stole I video game from Wal-Mart. We were both arrested and stayed another night in jail and bonded out again for $175.

    So, since I was already out on bail and I got arrested and got bailed out again, what happens?

    Also, these were my first arrest and I'm wondering what are my chances of avoiding jail time?

    I pled not guilty to the felony and have court on July 10th, where hopefully since Circuit City is out of business and the DA won't be able to obtain witnesses or other evidence, I will be offered a deal of some sort. These charges are filed in different counties.

    I have a good job, just bought a house, have a 6 month old daughter, and overall am a good peson. What should I do?

    Congrats. I have just added "took the big screen TV out to my car to make sure it would fit" to my list of worst excuses for shoplifting.

    I would not plan on a judge buying it.

    Even if it were true, why not bring the TV back into the store after fitting it in?

    No, the judge will believe that you were loading your car with everything it could carry ... that you were looting, not shopping.

    The lawyer was an excellent idea.

    Ask your attorney... because your first arrest have a very real chance of finding you in jail.

    The fact that CC is out of business means nothing. The witness names are nice to have, but not important.

    The police came and saw the evidence with their very own eyes. They saw you, the TV, your car and no receipt for payment. No other witnesses are truly necessary.

    Sell everything you own and hope your lawyer is worth it.

    My car could not have fit anything else in it. This was a 55 inch television box. Also, a CC employee was aware I was out front trying to make room foe the box to fit in my car. The only reason the police were called is because the peple viewing the security cameras were unaware of the situation.

    Again, this changes nothing.

    If you found a CC employee to help you get it into your car, why didn't you ask that employee to ring up the sale... or did you forget to mention that part?

    Let's talk about the persons viewing the tape. They saw you pluck a TV from the sales floor and move it to your car. They did not see you pay for it. What part of that situation was incorrect?

    If lawyer is somehow able to get the 1st charge dismissed b.c it's a felony there not as much of a chance for jail b.c the other charge is a misdeamanor. Talk to your lawyer and ask if a no jail plea bargain can be arranged. Your need to shop around and make sure that you find the best lawyer that you are able to afford.

    Two theft charges with in a short amt of time and the high value of the 1st one,Jail time is a real possablity.
