    Default Shoplifting Conviction

    MINNESOTA !

    Last fall I plead guilty to shoplifting. I was sentenced to 90 days jail, all 90 stayed and 1000 fine, 700 stayed. I've since paid the fine and looked at my sheet again and I'm now wondering what, what I was sentenced for, is classified as (ie Petty, Gross, 1st degree)

    On the top of the copy of the court report signed by the judge it has 3 boxes, one for petty, misdemeanor and gross misdemeanor. None of them are checked. Below that it has a box for count that has a "0" written in it and a box that says Charge Resulting In Plea or Finding of Guilt with 'theft' written in it.

    I don't know if what I was convicted of is considered a misdemeanor or infraction or what ? Does this help anybody or should I keep trying to get a hold of the court to find this info (which I've tried many times with no success)

    90 days sentenced with 90 days stayed. So i dont actually do any time. Don't ask me why they do it that way.

    what does that mean "90 days sentenced with 90 days stayed?" You got 90 days jail for ur first time offense?? Did you get a lawyer or did you just plead guilty without a lawyer??

    Please put some light in ur case because I am going through the same case. It really scares me now. which county was it? If you dont mind.

    Please provide some brief information..

    no no. I don't know if it's like this everywhere, but in Minnesota / Stearns County if you plead guilty they sentence you to the maximum, but then the judge chooses to 'stay' some of it, basically you don't have to do what was 'stayed' so I was sentenced to 90 days but he stayed all of it. So i don't have to do any time, same with the fine, I was fined 1000 but stayed 700 so in the end all I had was a 300 fine, I'm sure you can expect similiar.

    In other words, when the judge calls you up and says you are subject to blah blah blah that is the maximum penalty for the crime you committed, you almost NEVER get a full penalty for a first time offense..

    Oh! nearly scared me to death..Thanks for replying So did you get a lawyer and fought the case or you just dint bother getting one?? I am planning to pleading non-guilty retaining a lawyer..Any suggestions??? BTW..what abt the criminal record?? You still get the criminal record rite???
