I Got Pulled Over in Suspended, Failed My Community Service, and Classes

My question involves traffic court in the State of: CALIFORNIA

I got pulled over about a year ago, DUI. Got a lawyer and got 10 days of community service, 1st offender classes, and a fat fine. Last year Oct. I got pulled over on a suspensed due to my DUI, and i got court coming up for it, I was speeing a lil 45 on a 25 mph, it read i guess. also tinted windows. SO i got a case for that, but i also only completed 5 out of 10 of my sheriffs labor program (community service) days bc i had to come into work, on a sun. and didnt have time to do it, and i didnt have $$ to pay my classes so i got suspended from them and now terminated so i got a court case for that comign up as well, and i also havne paid any of my fines =/ due to bills, stress, fam. problems, and just been raining on me, What do you think will happen? I really hope i just get reinstated to community service, and my classes, they could suspend my license again i dont care i dont drive anymore, and i get fined, rather than jail time =/ anyone think thats possible? could really use some advice to put me @ ease

If that’s all you want to hear, then don’t read the rest of my post…

I assume you were charged for driving while suspended pursuant to CVC section 14601.2 which states:

(a) A person shall not drive a motor vehicle at any time when that person's driving privilege is suspended or revoked for a conviction of a violation of Section 23152 or 23153 if the person so driving has knowledge of the suspension or revocation.
…
(d) A person convicted of a violation of this section shall be punished as follows:

(1) Upon a first conviction, by imprisonment in the county jail for not less than 10 days or more than six months and by a fine of not less than three hundred dollars ($300) or more than one thousand dollars ($1,000), unless the person has been designated a habitual traffic offender under subdivision (b) of Section 23546, subdivision (b) of Section 23550, or subdivision (d) of Section 23550.5, in which case the person, in addition, shall be sentenced as provided in paragraph (3) of subdivision (e) of Section 14601.3.

As for your failure to complete your classes as well as the community service hours ordered by the court, those are considered a violation of the probation which you were placed on when those orders came down. Although I think it might add a few days to the jail sentence prescribed above pursuant to some law somewhere, I will leave it up to the Judge to tell you what he/she will penalize you for those.

Lastly, the speeding and window tint violations, only carry fines but no jail time…

You might want to call that same attorney back up! Personally, I wouldn't even think about going at this on my own.

I agree with That Guy. You have yourself all screwed up. You need to first recognize that all of this is your fault. Had you done the community service, etc. that you were supposed to do, you would be ok. You need to accept this so you don't go to court with an attitude like "this is BS...." Humility will take you a long ways here.
