Default Answer Filed and Case Benched, What Next
State: Kansas, Johnson County, 10th Judicial District Court, Civil

I filed my answers with the court stating my affirmative defenses and requesting that the debt be extinguished and dismissed with prejudice. It has been 18 working days since my court date. I called after 10 working days and the clerk said that the Judge had noted that the answer was received and the case had been benched. Did I misunderstand her or what does that mean? I have tried finding this procedure in the Kansas Legislation but have not had any luck. I have not received anything in writing from the court or the plaintiff so I am wondering what is next.

I don't want to guess as to what the clerk meant by the case being benched. That could mean a number of things, assuming you even heard correctly. I suggest asking the clerk.

Sounds like a bench trial. If you did not request a jury trial in your answers and the plaintiff didn't request a jury trial in its complaint, your case will be heard by a judge without a jury. The next step is that the other side or you will move for motions on the pleadings to dismiss or for summary judgment, or you go to trial. Make sure you are aware of discovery deadlines and you request whatever discovery you need from the other side.
