    Default UI First Extension Denied

    My question involves unemployment benefits for the state of: California

    I received a denial notice today stating "your claim for the emergency unemployment compensation extension is not allowed on your regular claim dated 2/15/2009...........because you do not have earnings in excess of 40 times your weekly benefit amount or 1.5 times the highest quarter in the base period of your regular claim dated 2/15/2009"

    My 2/15/09 claim was based on quarter ending 9/30/08. Can I file a new claim based on quarter ending 12/31/08 (I was employed until 2/09) now?

    Yes, and they will again review your application to see if you qualify for benefits.

    I received a notice now stating "we are unable to process your application because benefits are exhausted on a claim that has not expired. Please contact the department 1-5 days prior to 2-13-10 to determin if you are eligible to a later claim". I can't get through to EDD - I have been trying for days and they don't even put you on hold. They just say they are too busy and to call back.

    I am confused about what the notice means. Any ideas if this means I am not eligible to benefits now?

    kenth, if your claim started on 2/15/09 then your claim expires one year later, which would be 2/15/10. You can't file a second claim during that period. You can begin filing your second claim 5 days before 2/15/10 of next year. I just recently learned that myself. I'm eligible to file a second claim but I had to wait until my first claim year was expired before I could actually file for a new one.

    When you file for the second claim in 2010, they will look at your earnings as far back as 2008 to determine how much you can receive in benefits. Hope that helps buddy....good luck!

    Is there anyway I can appeal this? I worked from 10/1/2008 to 5/19/2009 and have collected benefits at the highest amount allowed from then until now. I have until 10/13/2009 to file an appeal. I didn't work for 5 years before this job.
