    Question Life Estate: Full Ownership of Remaindermen Automatic when Tenant Dies

    State of MN
    I understand the remaindermen get full ownership when the life tenant dies with a life estate deed. My father just passed away. But is it automatic through the legal terms? or does something need to be filed other than a death certificate?? and to whom?

    As you were told in your other thread, there's no need for a new deed. You were also told there what steps you can take to get a new deed, if for some reason you want one. Make sure to let the tax authorities know about the (automatic) change of ownership, and where to send the property tax bill.

    If the estate's still being probated, it may be possible to get a deed via the personal representative. (No promises there; the personal representative is authorized to preserve a lien against the estate that survives transfer by life estate by issuing a deed subject to the lien, but there's no similar provision for the issuance of a deed when no lien attaches.)
