Default Failure to Return Rental - Felony Charges

My question involves criminal law for the state of: Virginia

My ex who I speak with from time to time is looking at Failure to Return Rental Property (Code 18.2-117) in Hampton, Virginia. It was filed by the manager of the car rental store. She would never tell me this, but I think she may have a lot more going against her than she may think. The car has been returned and fees have been paid, but the manager is still going ahead with the case. Back in 2004 she was caught up in Grand Larceny/Conspiracy (Code 18.2-22). It was continued and finally she plead guilty to misdemeanor embezellment in Jan 2006. She paid fines and served no time, but I know the Hampton Virginia judge will see this and not like it. Is there any chance she can get off and not serve any time? Even though we aren't together, I still don't want to see her go to jail over this. She has been through enough lately.
