My uncle was refused entry saying he is found to be working on his previous visit. He has visitor visa. Then he said at port of entry he doesn't want to go back fearing for his life on his country. Now he is held at detention for almost 2 weeks and went through his credibility fear test. But now he wants to go back. He hasnt fill any asylum application. He is just waiting for his credibilty fear test interview result. so my question is will he fall on to deportation procedures or refused entry. Is there any way we can apply for volunteer departure? lastly do ICE keeps record of his saying he was seeking asylum?

Yes. If he's claiming asylum, applies for voluntary departure to go back to the place he claims to be in mortal danger, then eventually tries to come back to the US? He'll be denied admission almost to a certainty.
