Asylum Denied

9th Circuit denied the appeal application. An immigration attorney said that if I stay in the country and my son who has applied for citizenship just recently can then apply for me and if I did not leave the country then I can become legal but if I leave the country then there will be a bar of 10 years.

My question is if I stay in the country which would be considered illegal but I did enter legally and my asylum was denied and when my son applies for me will I get into any trouble with INS?

You should be asking your lawyer.

If you enter legally, and you haven't been deported, you should be able to adjust your status at a later date (such as if your son successfully petitions for you to get a Green Card), but before that happens you have no status and thus could potentially be picked up and deported. Your lawyer can clarify based upon the specific facts of your case.
