Minor in Possesion California Charge

I'm from Los Angeles, CA and im 16 years old. A couple days ago i got caught out past curfew by 3 under covers. We were just sitting there and they came and asked to search all of us. I didn't think i had anything on me but it turns out my friend left their alcohol in my purse which was a can of JOOSE, so i got a possession of alcohol ticket. Luckily they only gave me that and not a curfew ticket. But I'm afraid that im going to lose my license for a year but is there anyway i can get a less bad punishment and not lose my license for that long?? also does anyone know what the normal punishment is for this?

im a good student and this is my first time ever getting in trouble. do u think this will affect my punishment in any way?

What is the code section on your citation? If it is NOT B&P 25662 then it is probably a municipal code and you would have to post what city you were in at the timed.

If it IS 25662, then your license status is in jeopardy. if it is NOT 25662, and it is a muni code, then your license may NOT be in jeopardy.

also is it even a misdemeanor? i wasnt under the influence cause i was driving and they didnt breathalize me or ask me if i had been drinking that night. im worried that they may have assumed i was drinking and that may have affected my ticket what should i do?

also should i get a lawyer or attorney or something? i do not think it is fair that i got charged with a misdemenor because i was one of the only people there not doing anythining and i got the worst ticket while everyone got only curfew tickets while other people had cigarettes and were smoking and drinking

That M that was circled means that it is a Misdemeanor... your license is in jeopardy as it should be. Lucky you didn't get a curfew ticket? Child, you got the unlucky ticket.

As for fair, life isn't fair. Perhaps you should pick better friends and watch the company you keep. Obviously you are all out of control. If your parents can't properly supervise you, then the court will. Since you cannot retain an attorney on your own, perhaps you should talk to your parents. They will need to appear in court with you anyway.

Personally, 1 violation or 2 doesn't matter. You're 16 and establishing a record within the court system.

i came here asking for advice because i felt that what happened to me was not fair. I know i had it in my purse. It wasnt mine i wasnt in a car and i was one of the most responsible people there. I dont think what i did is a misdemeanor because i know people who have done the same exact thing and it was an infraction.

What you think is irrelevant. The LAW says it is a misdemeanor. That's all that counts. You had alcohol in your possession. You made a bad choice and now you get to deal with the consequences of your actions.

Like I said, get yourself back on track and find better friends before you find your future ruined before it even gets started.

CVC 13202.5 mandates that the court SHALL suspend the license of a person convicted of BP 25662 for one year. Being in or around a car is irrelevant.

However, if you can petition the court with some compelling "critical need to drive" and they may issue a restricted license. However, at age 16 that is not too likely.

And, yes, it is a misdemeanor but is is often prosecuted in traffic court as an infraction, or filed with the juvenile court as a misdemeanor. How YOUR county handles it I cannot say.
