Trying to get started with the process of obtaining a K-1 visa for my fiancee. What I'm wondering is, from the perspective of the US government, does she need to be a legal resident of the country in which she currently lives (and in which lies the US embassy in which we hope the interview will take place)? Would it be ok if she was living in that country on a tourist visa, for example?
I suspect that it doesn't make a difference but I'd like to hear others' thoughts.
A similar question, possibly with the same answer (hopefully "doesn't matter") is whether it matters if the fiancee is technically living illegally in the country in which she lives (and in which we want the US embassy to issue the visa), meaning for example that she overstayed her visa a long time ago.
No self-righteous, arrogant, or irrelevant answers are necessary.
Thanks for your insight.
