    Question Ohio Child Support - Still Married

    My question involves child support in the State of: Ohio

    My friend lives in Indiana, and his spouse is living in Ohio. They are married, not legally separated, and are living apart because of personal reasons. The child support hearing was today in Ohio, oddly enough in the city I live in. It was done by the judge who married my wife and I. He's a good guy, so the way he treated my friend comes as a surprise to me.

    Just this morning in an extremely brief court session he was ordered to pay child support. I'm a little confused by this. He does, on occasion, take the kids. She's reluctant to let him have them, but just this weekend they stayed with him. He has bailed her out multiple times on bills and has receipts for it. He has no problem picking the kids up when she wants to go out, and he enjoys spending time with his children.

    I'm confused by this, as is he. I'm hoping someone can give me some advice. I'm actually mildly enraged by the situation. She's the reason he left the house, she quit her job, and she currently doesn't have running water. She chose her internet addiction over running water for the children, and that upsets me. He's more than willing to take them in, but she refuses, and he doesn't want to cause a fight and turn it into a tug of warm game with the children.

    What should he do to see about getting custody and getting rid of the child support? He's currently pursuing divorce, but would prefer something more immediate considering there's no running water, and a few other issues.

    Since there's no custody order and they're not legally separated I'm not really sure what to do. As far as I'm aware, and what both a lawyer and the police told us, either parent can just do whatever with the kids. As far as we're aware he could take the kids, enroll them back in their old school, and nothing would be done about it.

    As soon as he files for a divorce, he can request a temp custody/visitation order.
