Default Attach with Notice
Good Evening,

I live in NH and received a summons today to respond to a petition for Attachment with Notice on my home. According to the petition, the lawyer for the collection has stated that I owe a certain amount (I dispute the amount) and that they feel that if a judgment is awarded in their favor that they need the attachment of the real estate to ensure they get paid.

Two issues, I put my home on the market 2 weeks ago and I am selling it as a short sale. We are behind and looking to get out. If they obtain approval for the attachment, how is the sale affected?? Also, I am going to respond to the court and also Answer the petition. Should I also try to work out a settlement with the plaintiff's lawyer that filed the petition. I don't dispute the depbt, only the amount.

If you get an attachment against your home, that would have to be pid off in association with the transfer of title; so that could interfered with a short sale. If you can work out a settlement and avoid attachment, it shouldn't have any impact on your short sale.
