Father Wanting to Change Last Name to His in Ohio

My question involves name change laws in the State of: ohio
My son is seven months old and his father and i tried to have a relationship together which fell apart. The baby has my last name on the birth certificate from time of birth. We have never been married and he recently had me served with papers to have my sons last name changed to his now. Even though we had a paternity test I never put anyone down on the birth cetificate either. Does he have the right to do this? My attorney said himself he relly doesnt even know how this will turn out. Help!!!

Does he have the right to petition the court to have the child's name changed?

Sure.

Will he get what he wants? Your attorney is correct, there's no way to predict how the court will rule on it.

He does, however, have a right to be listed on the birth certificate, since the paternity test confirmed that he is the father.
